CONTRACTING PARTIES
- Lessor: Na Fent, located at Av. Mediterrània, 344 local 3 and 4 – 17256 PALS (Girona), NIF 46564540M, represented by Olga Alamán.
- Lessee: The person or entity renting the bicycle(s) under the conditions set forth in this contract.
SUBJECT OF THE CONTRACT
- Temporary rental of bicycles with corresponding serial numbers and associated accessories.
- The rental is conducted under a payment-by-hour/day/week model as indicated in the quote or on the website.
RESERVATION AND PAYMENT
- To confirm the reservation, the total rental amount and deposit must be paid.
- Payment methods accepted are credit/debit card, cash, or bank transfer.
- If payment is not confirmed within 24 hours, the reservation will be automatically canceled.
DELIVERY AND RETURN
- The rental period will begin on the agreed date and end on the date stipulated in the contract.
- The lessee must return the bicycle at the same location and in the same condition in which it was received.
LESSEE’S OBLIGATIONS
- The lessee must always comply with the Traffic Code and traffic signs.
- The lessee may not transfer or sublet the bicycle to third parties.
- Participation in races, speed trials, or unauthorized off-road activities with the rented bicycle is prohibited.
- The lessee agrees to maintain the bicycle in good condition and to report any incidents or damage immediately.
GEOGRAPHIC SCOPE
- The use of the bicycle is limited to the Baix Empordà territory.
- If the lessee leaves this area without prior authorization, penalties may apply, and the contract may be terminated immediately.
MAINTENANCE AND BREAKDOWNS
- The lessee is responsible for repairs due to misuse or negligence during the rental period.
- Normal wear of components such as brakes or tires is covered by the lessor.
- If dangerous or unsafe use is detected (e.g., under the influence of alcohol or drugs), the lessor may terminate the contract immediately and retain the deposit.
INSURANCE AND LIABILITY
- The lessor holds a liability insurance policy covering third-party damages in case of accidents.
- Gross negligence, participation in races, or illegal acts are not covered by insurance.
- The lessee agrees to indemnify the lessor for any fines, penalties, or third-party claims arising from the use of the bicycle.
PENALTIES
- Late return: The lessee must pay a penalty proportional to the hourly rate contracted.
- Loss or theft without a report: The lessee must pay the replacement cost (based on the bicycle’s value).
CANCELLATION
- More than 7 days before: 100% refund.
- 3 days before: 50% retention.
- Less than 24 hours or no-show: no refund.
MODIFICATIONS
- The lessor reserves the right to modify these terms by changing the text on the website. Continued use will imply acceptance of these changes.
DATA PROTECTION
- Personal data provided will be processed in accordance with the General Data Protection Regulation (GDPR) and the Organic Law on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD) for managing bookings and rental contracts.
- The lessee has the right to access, rectify, delete, and object to the processing of their personal data by contacting info@nafentbikes.com. The full privacy policy is available at nafentbikes.com.
ELECTRONIC SIGNATURE
- The lessee accepts the validity of the electronic signature through platforms such as DocuSign or Signaturit, in accordance with Law 59/2003 and the eIDAS Regulation of the European Union.
FORCE MAJEURE
- Neither party will be held responsible for failing to meet obligations under this contract due to events beyond their control, such as extreme weather, strikes, pandemics, natural disasters, or actions by authorities.
JURISDICTION AND APPLICABLE LAW
- This contract is governed by Spanish law.
- Both parties agree to submit to the jurisdiction of the Courts of Pals for the resolution of any dispute related to this contract.
